Legal Requirements for Selling Property in Portugal

To move forward with selling your property, it´s necessary to sign a standard mediation contract as required by Portuguese law. This agreement formalizes our partnership and allows us to begin marketing your property.

Additionally, certain key documents are needed for the sale. Your lawyer should be able to provide these, but here’s a list of what you will need:

  1. Caderneta Predial (Property Tax Registration Document)


Issued by the Finanças (Tax Office), this document details the tax registration of the property. It includes information such as the property’s fiscal number, the current owner, and its fiscal status.

  1. Certidão de Teor (Land Registry Certificate)


This certificate shows the legal ownership of the property, any rights associated with it, and if there are any mortgages or liens registered against it.

  1. Licença de Habitabilidade (Habitation License)


For properties built after 1951, a habitation license is required to confirm that the property has been deemed suitable for living. This certificate is essential to prove that the property complies with habitation standards.

  1. Escritura (Deed of Sale)


This is the final document signed when the property transaction is completed, officially transferring ownership from seller to buyer.

  1. Ficha Técnica de Habitação (Technical Property Report)


This report provides detailed technical information about the property, including details about the construction materials, the builder, and the suppliers involved.

  1. Property Plans


The official architectural plans of the property should be provided. Ensure your lawyer verifies that the plans match the current layout of the property.

  1. Identificação Fiscal (Tax Identification Number)


A personal fiscal number obtained from the Finanças is required for all property transactions in Portugal.

  1. Energy Efficiency Certificate


Since 1 January 2009, all properties being sold in Portugal must have a valid energy certificate. Properties are rated from A (most energy-efficient) to G (least efficient). Obtaining this certificate is essential before completing a sale.
